1. Introduction and Acceptance

This website (the "Site") is owned and operated by Walla Walla Motors, Inc., doing business as Chrysler Dodge Jeep Ram of Walla Walla ("CDJR of Walla Walla," the "Dealership," "we," "us" or "our"), 2695 E Isaacs Ave, Walla Walla, WA 99362. The Site is hosted and powered by Dealer Dot Com, Inc. ("Dealer.com"), a Cox Automotive company, which provides the website platform on our behalf.

These Terms of Use (the "Terms") govern your access to and use of the Site. By using the Site, you confirm that you are at least 18 years old and that you agree to these Terms. Our Privacy Policy and our Legal Site Disclaimer are part of these Terms by reference. If you do not agree, please do not use the Site.

These Terms cover the Site only. Any purchase, lease, financing, trade-in or service transaction is governed by the written documents you sign with us at that time, and those documents control over anything on the Site.

2. Site Content and Your License

We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Site for your own personal, non-commercial purpose of shopping for vehicles, parts, accessories and service from us. You may print or save individual pages for that purpose as long as you keep all copyright and other notices intact. Any other copying, reproduction, redistribution, modification or commercial use of Site content is not permitted without our prior written consent. This license ends automatically if you violate these Terms.

3. Trademarks and Manufacturer Notice

Chrysler, Dodge, Jeep, Ram, Mopar, HEMI and SRT are registered trademarks of FCA US LLC. Vehicle model names, trim names, feature names, logos and grille designs shown on the Site are trademarks of FCA US LLC or its affiliates and are used under license. FIAT and ALFA ROMEO are registered trademarks of FCA Group Marketing S.p.A., used with permission. Other names and logos on the Site belong to their respective owners, including Dealer.com and Cox Automotive.

CDJR of Walla Walla is an independently and locally owned dealership. We are an authorized retailer of Chrysler, Dodge, Jeep and Ram vehicles, but we are not owned by, and we are not an agent of, FCA US LLC or Stellantis. Nothing on the Site grants you any right to use any trademark without the owner's written permission.

4. Software

Any software, tools, calculators or applications made available through the Site (including tools supplied by Dealer.com or other providers) are owned by us or by our licensors and are protected by law. You may use them only as provided on the Site. You may not copy, decompile, reverse engineer, disassemble or create derivative works from them, except where applicable law expressly permits it.

5. Information and Materials You Submit

When you submit a lead, inquiry, credit application, trade-in description, review, photo, comment or other content ("Materials"), you grant us and our service providers a non-exclusive, royalty-free, worldwide license to use, store, reproduce and display those Materials to respond to you, provide the products and services you request, operate and improve the Site, and, for reviews and photos you choose to post publicly, display them on the Site and in our marketing. Personal information in your Materials is handled as described in our Privacy Policy. You keep ownership of your Materials. We may (but are not required to) review, edit or remove any Materials.

6. Vehicle Pricing, Incentives and Offers

  1. Advertised prices. We will not sell a vehicle for more than its advertised price, regardless of any trade-in allowance. Unless an offer clearly states otherwise, the advertised price of a new or used vehicle includes all charges we require, including any dealer-installed equipment, accessories or protection products already on the vehicle and any reconditioning, preparation or dealer-added charges. The only amounts added are those Washington law allows: sales tax, license, title and registration fees and other government charges, the documentary service fee described below, and the price of any additional equipment or products you choose to order.
  2. Documentary service fee. A documentary service fee in an amount up to $200 may be added to the sale price or the capitalized cost. The documentary service fee is negotiable, is not required by the State of Washington, and will be shown separately from the vehicle price and from taxes and other fees.
  3. Optional products. Service contracts, GAP coverage, maintenance plans, appearance protection, accessories and similar products that are not already on the vehicle are optional. You do not need to buy any of them to purchase or lease a vehicle or to get the advertised price, and they will be added only with your express agreement.
  4. Financing is not required. Unless an offer clearly and conspicuously states that it is a financing or lease offer with specific terms, advertised prices do not require you to finance through us. Advertised financing and lease terms are subject to credit approval by the lender, and the annual percentage rate, term, amount due at signing and other material terms will be disclosed with the offer.
  5. Manufacturer rebates and incentives. Rebates, bonus cash, special APR and lease programs are offered by FCA US LLC or its affiliated or designated lenders, not by the Dealership. They may be limited to specific models, regions, dates, residency or eligibility groups (for example, military, first responder or loyalty programs) and may change or end without notice. Where an advertised price includes a rebate, the offer identifies each rebate included and its conditions. Rebates that cannot be combined will not be shown as combined. Where a rebate requires dealer participation, dealer participation in this rebate program may increase vehicle price before rebate. Please ask us to confirm which incentives you qualify for.
  6. Availability and identification. Vehicles are subject to prior sale. An offer for a specific vehicle identifies it by stock number or VIN, and any offer limited in quantity or time will say so. A vehicle shown as "in transit" or "on order" is not available for immediate delivery. Vehicles from the last two model years that are not new will be labeled "used" or "demo."
  7. MSRP, photos and specifications. MSRP is the manufacturer's suggested retail price and is provided for reference. Photos may be representative, and options, colors, features, fuel economy, range and specifications come from the manufacturer or third-party data providers and may change. Mileage on used vehicles may change slightly with test drives.
  8. Used vehicles. Each used vehicle is sold with the Federal Trade Commission Buyers Guide displayed on it, which states whether the vehicle comes with a warranty or is sold "as is." The Buyers Guide is part of your contract. Vehicle history reports are provided by third parties and may not reflect every event in a vehicle's past. We encourage you to inspect any used vehicle and to have it inspected by a mechanic of your choice.
  9. Errors and verification. Inventory, pricing and incentive information is supplied by us, the manufacturer and third-party data feeds and is updated regularly, but errors can happen. If we find an error, we will correct it promptly. Where Washington law requires us to honor an advertised price, we will. Before you buy, please confirm the price, equipment, incentives and terms of a specific vehicle with a member of our team.

7. Rules for Leads and Submitted Content

When you submit Materials, you agree that they:

  1. are accurate and are about you or a person who has authorized you to submit them;
  2. do not use another person's name, phone number, email address or identity without permission;
  3. do not infringe any copyright, trademark, privacy, publicity or other right;
  4. are not unlawful, defamatory, threatening, harassing, obscene or discriminatory;
  5. do not contain viruses, malicious code or automated or bulk submissions;
  6. are not advertising, solicitations or spam; and
  7. do not include sensitive information that the form does not ask for, such as Social Security numbers outside our secure credit application, or any health information.

We respect intellectual property rights and respond to notices that follow the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA"). If you believe material on the Site infringes your copyright, please send a written notice to our designated agent:

Your notice must include:

  1. a physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf;
  2. identification of the copyrighted work you claim is infringed (or, for multiple works, a representative list);
  3. identification of the material you claim is infringing and enough information for us to locate it on the Site, such as a URL;
  4. your name, mailing address, telephone number and, if available, email address;
  5. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

We may remove or disable access to material in response to a valid notice and may notify the person who posted it, who may send a counter-notice as the DMCA allows. We may end access for repeat infringers.

9. Interactive Features

The Site may include chat, reviews, comments, trade-in tools, digital retailing tools or similar features ("Interactive Features"). Some are operated by third-party providers. You are responsible for what you post, and your content must follow Section 7. Content posted by other users reflects their views, not ours. We may monitor, moderate or remove content at our discretion. Chat conversations may be recorded and retained.

10. Registration and Consent to Calls, Texts and Emails

Some features may ask you to create an account or provide contact information. You agree to give accurate information, keep your login details confidential and tell us about any unauthorized use of your account.

When you submit a form on the Site and check the consent box or otherwise expressly agree, you authorize CDJR of Walla Walla to contact you at the phone number and email address you provide about vehicles, financing, service, offers and your inquiry, including by calls and text messages that may be made using automated technology or prerecorded or artificial voice messages. Your consent is not a condition of purchasing or leasing any vehicle, product or service. Message frequency varies, and message and data rates may apply. You can withdraw consent at any time by replying STOP to any text, by using the unsubscribe link in any email, or by contacting us using the information in Section 23, and we will honor your request as required by law. You confirm that you are the subscriber or customary user of the phone number you provide. Calls to or from the Dealership may be recorded or monitored for quality and training.

11. Our Rights

We may change, suspend or discontinue any part of the Site, limit features or access, and refuse service to anyone who violates these Terms, at any time and without liability, to the extent permitted by law. All rights not expressly granted in these Terms are reserved by us and our licensors.

12. Prohibited Activities

You agree not to:

  1. use the Site for any unlawful, fraudulent or deceptive purpose;
  2. use any robot, spider, scraper, crawler or other automated means to access, copy, collect or index Site content, inventory or pricing, except search engines operating under our robots.txt file;
  3. harvest or collect personal information about other users;
  4. submit false leads, false credit applications or information about another person;
  5. interfere with, overload or disrupt the Site, its servers or networks;
  6. try to gain unauthorized access to any part of the Site, other accounts or connected systems;
  7. introduce viruses, malware or other harmful code;
  8. bypass any security, access-control or rate-limiting feature;
  9. frame or mirror the Site, or deep-link in a way that suggests our endorsement, without our written permission;
  10. resell or commercially exploit Site content, data or features;
  11. impersonate any person or misrepresent your affiliation with any person or business; or
  12. use Site content or data to train or develop artificial intelligence or machine-learning models without our written consent.

13. Information Disclaimer

Site content is provided for general information to help you shop. It is not financial, legal or tax advice. Payment calculators, trade-in estimates and similar tools give estimates only and are not offers of credit or binding appraisals. Final terms depend on vehicle condition, credit approval, eligibility and the documents you sign.

14. Third-Party Links and Tools

The Site may link to or embed websites, tools and services operated by others, such as the manufacturer, lenders, vehicle history providers, valuation providers, map services and social media platforms. We do not control them and are not responsible for their content, accuracy, privacy practices or availability. A link does not mean we endorse the third party or that it is authorized to use our marks. Your use of third-party sites is governed by their terms and privacy policies.

15. Your Representations

You represent that you are at least 18 years old, that the information you provide is true and accurate, that you have the right to submit any Materials you provide, and that your use of the Site complies with these Terms and applicable law.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless the Dealership, its owners, officers, employees and agents, and its service providers including Dealer.com, from third-party claims, losses and reasonable attorneys' fees arising from your violation of these Terms, your Materials, or your misuse of the Site. This section does not apply to claims caused by our own negligence or misconduct.

17. Warranty Disclaimer

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR SERVICE PROVIDERS DISCLAIM ALL WARRANTIES ABOUT THE SITE, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL CODE. THIS SECTION APPLIES TO THE SITE ONLY. IT DOES NOT CHANGE ANY WARRANTY THAT COMES WITH A VEHICLE, PART OR SERVICE YOU BUY, ANY MANUFACTURER WARRANTY, OR ANY WARRANTY OR RIGHT YOU HAVE UNDER WASHINGTON OR FEDERAL LAW.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE DEALERSHIP AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE, AND OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US THROUGH THE SITE FOR THE ITEM GIVING RISE TO THE CLAIM OR ONE HUNDRED DOLLARS ($100). THIS LIMITATION DOES NOT APPLY TO CLAIMS ARISING FROM A VEHICLE PURCHASE, LEASE, FINANCING OR SERVICE TRANSACTION, TO CLAIMS UNDER THE WASHINGTON CONSUMER PROTECTION ACT (RCW 19.86), OR TO ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

19. Suspension and Termination

We may suspend or end your access to the Site or any feature at any time if we reasonably believe you have violated these Terms or the law, or to protect the Site, our customers or others. Sections 3, 5, 8 and 15 through 20 survive termination.

20. Governing Law, Disputes and Other Terms

  1. Governing law. These Terms are governed by the laws of the State of Washington and applicable federal law, without regard to conflict-of-law rules.
  2. Venue. Any lawsuit arising from these Terms or your use of the Site must be brought in the Superior Court of Washington for Walla Walla County or the United States District Court for the Eastern District of Washington, and you and we consent to the jurisdiction of those courts. Nothing in this section prevents either party from bringing a qualifying claim in small claims court.
  3. Time to bring claims. Any claim arising solely from your use of the Site must be filed within one (1) year after it arises, unless applicable law requires a longer period. This time limit does not apply to claims arising from a vehicle purchase, lease, financing or service transaction or to claims under the Washington Consumer Protection Act (RCW 19.86) or other consumer protection laws, which remain subject to the time periods set by law.
  4. Class actions. To the fullest extent permitted by applicable law, claims arising solely from your use of the Site will be brought individually and not as a plaintiff or class member in any class or representative proceeding. If this paragraph is found unenforceable as to any claim, it will not apply to that claim, and the rest of these Terms will remain in effect.
  5. Severability. If any provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force.
  6. No waiver; assignment; entire agreement. Our failure to enforce a provision is not a waiver. We may assign these Terms. You may not assign them without our consent. These Terms, together with the Privacy Policy and Legal Site Disclaimer, are the entire agreement between you and us about the Site and do not replace any signed sales, lease, finance or service document.

21. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page shows when they were last changed. Changes take effect when posted and apply to your use of the Site after that date. They do not apply to any dispute that arose before the change. If you continue to use the Site after a change, you accept the updated Terms.

22. Website Platform Provider

The Site is hosted and supported by Dealer Dot Com, Inc. (Dealer.com), a Cox Automotive company, which provides the website platform, inventory display and related tools on our behalf. The Dealership is responsible for the vehicles, prices, offers and other dealership content published on the Site. Dealer.com's own website and services are governed by its separate terms and privacy policy.
